Thanks for all the advice guys. I respect your guys' opinion that what I'm doing is petty, but at the end of the day I gotta do what I feel is right. If you don't believe my story that's fine too, one kind forum member warned me not to try and prove anything since there are people trying to DoXX forum members so thanks for that. I'll continue to update this thread as the situation unfolds.

It's small claims court, he's not litigating a lawsuit against Microsoft. Small claims cases can be filed by the snap of a finger. Once you get a judgment, you're golden. You have almost a restaurant menu of choices in collecting. Her credit will be f'd if she doesn't pay.

I once had someone screw me over, I sued, I won, they laughed even after judgment, I had the last laugh the sheriff went to their business and emptied out their cash register.

What about getting it back another way? Let someone who knows her convince her to give it back? Not sure but if people around her know you didn't cheat, and she ended the relationship, then maybe that risk to her reputation will cause her to give it back. Tough situation, It might be a lost cause, risky investment, a lot less risky than marrying without a prenup though.

Don't understand all the shit the OP is getting. It's a simple small court claim, he won't lose too much time with it, he'll probably win it, get some satisfaction of of it by not letting his ex & family fuck with him and send out a message to not try other shit afterward. On top of that its 6000$, not really pennies either is it?

Maybe you guys are focusing too much on trying to be the cool guy who cannot be faded by something material. The other side though is a man that defends his honor and principles no matter what.

This kind of reminds me of that forum post of a guy that had his wallet snatched by another guy he met at the hostel. Many gave the advice to no do anything since it's just a wallet and he could get injured physically. Makes sense, but fuck me, if someone tries to disrespect you like that in such an obvious way I'd rather live with a broken nose for a couple of weeks than with a broken ego for the rest of my life. Not exactly the same, but you get the point. Draw your borders and defend them.

And on top of that, think of the collective impact. If all men would just let it go, it sends a message to all women that this is a normal and profitable thing they can do, fuck over their ex in any way they see fit, hence it will occur more frequently. Society is mainly fucked right now, because men have lost the will to defend principles and their honor. Remember women are acting in unity in societal dynamics, while men are mainly doing stuff individually and we (men as a whole) have been suffering because of it. The reason this forum exists is to stop that trend.

@rotten appreciate ur post. I’m not here for validation I understand and appreciate all the negative comments as well I know you guys aren’t hating just trying to help. At the same time to me being alpha is doing whatever the fuck I want to do (albeit with wisdom) and this is something I want to do because I think it’s an injustice. And it doesn’t cost me much more than 15 minutes before a judge.

FYI she was served today court date is in a few weeks will keep you guys posted. First date is with mediator and if cannot work out agreement goes before judge the following day.

In most jurisdictions, the chances that he wins are around 100% as long as he can establish that it was an ring for an engagement she broke off. This has standing in law that a dress does not. Female judge will give zero fucks. Nothing pisses off a judge of either gender in small claims court faster than some 'tard who already knows they're wrong making some poor sap sue them and waste the court's time. Judge could have been banging the bailiff in her chambers and instead she's listening to two strangers argue about their breakup, the only question is which one is the idiot who she should be angry with for letting it get to this point. They realize this is miserable for everybody, including themselves. As long as OP looks like he has clean hands and has been behaving reasonably while asking for the ring back, it's likely a slam dunk.

Winning, however, isn't the same as collecting, and things OP has said since I posted before have raised all kinds of questions about what's really going on here.

I would say forget about the ring, and her and move on. Getting the ring back probably won't help you with the grieving process.

If you feel that strongly about it, consult with a lawyer. Its possible to spend 50% of what the rings worth just in litigation costs alone. I.e. missing work, fee to file small claims paperwork, lawyer if you lawyer up etc etc...

I agree with Suits, beware. Both those cases seem antiquated and my guess wouldn’t stand up to shepardizing even if they were binding in your jurisdiction. The notion that marriage was a condition subsequent to the contractual consideration given is a tall order to prove. However, you seem hell bent on proceeding so best of luck.

I think the scenario your talking about is if the guy left the woman. Welp had my trial today. Won the ring back. Turns out even both parties break off an engagement by mutual consent ring goes back to giver. I had a ton of evidence that it was her fault but at the end of the day didn’t even need it.

Definitely an interesting experience. I clearly had the stronger case and won. Was a female judge but was pretty impartial imo.

The ex held her composure ok but her case was a jumbled mess of hamster logic.

At the end of the day, I’m glad I went through with it. Learned a lot about court and I’m even more glad I dodged a bullet as I found out she tried to file a police report about all sorts of crazy stuff (domestic abuse, etc) that were completely made up.
