Hick Judge forces man to marry girlfriend over threat of jail time

"We figured he'd get probation but were surprised about the other conditions, especially the marriage," Jaynes told CNN on Friday.

"Then the the judge asked Josten if I was worth it and if we were living together, and we both said 'yes.' When the judge said part of the probation was that we had to get married Josten smiled at me and I was turning red.

Eventually the government is going to force men to marry dried-up harpies. It's just a matter of time before this goes mainstream. I wonder how many other things the Judge did over the years like this?

So much wrong with this I don't know where to begin.

So basically beta boy gets in a little scuffle with his ex's boyfriend and a judge sentences him to 15 days in jail or 2 years of probation in Marital and Mental prison. Get the fuck out of here!

Take the 15 days in jail. 2 years of marital probation after dude already has demonstrated violent tendencies means his wife will literally own his ass. If he as much as raises his voice to his new wife she can run to the courts and say he is being abuse and she can stick his ass with real time when he goes back before the judge. Hell, he can walk in and catch his wife fucking a new dude every week and he's got no eject option. If he gets violent that's his ass. Plus if he is working like a good beta she can grab some cash after the inevitable divorce.

It seems like the judge probably knew the couple or at least their families and thought he was helping out the beta (lets face it, homie cannot do any better). Still this shit sets a dangerous precedent, probation on the condition of marriage for simple misdemeanor crimes. A government sanctioned shotgun marriage puts even more power in a female's hands, as if they needed any more.

Then you got the religious bullshit. Dude is forced to write the same bible verse 25 times a day? For two years? Are you fucking kidding me? I know this is hicktown Texas but this is still the US, what about separation of church and state? If this isn't religious brainwashing I don't know what is.

Could you imagine a woman, muslim, atheist, jewish person or GLBT given the same ultimatum, marry the person you are banging and copy bible verses daily because of a misdemeanor or go to jail? The outrage would be unprecedented.

I'm torn on this one.


On one hand, the judge is making good strides in combatting the "Lets you and him fight" behavior condoned by, and even encouraged from women. It just isn't worth it, It wasn't worth it, it never will be worth it. Just a hunch, but something tells me this girl didn't do anything to de-escalate or stop the situation from happening.

On the other hand, its everything you all said above - the judge gave him a choice between a lifetime of jail or 15 days in jail. I would have taken the 15 days.

People are encouraged to get married in order to get better results in criminal court cases all the time. I just haven't seen a judge "force" anyone to do so. Apparently the girl who the guy ended up marrying wasn't the victim here. She may very well have been a state witness who was subpoenaed to testify against the Defendant, either willingly or unwillingly. Many, or possibly even all, states have marital/spousal privilege statutes which give a person the right to refuse to testify against his or her spouse in a criminal proceeding. Some states have limitations on this, for example the privilege can only be used once in an assault case. Many people basically live together as husband and wife and have children together, but were never legally married. In those cases, prosecutors often play silly games, because they can, and make the alleged victim testify against the Defendant. I often encourage clients in such a situation to simply get married in order to avoid having the victim be compelled to testify against him or her. If there is any other witnesses and/or witnesses (There usually isn't), the Defendant could still be found guilty, even if the spouse invokes the privilege. I'm thinking here, that the girl who he was ordered to marry was a witness, although not a victim in this case and that was a factor in the judge doing what he did.

I'm having real cognitive issues trying to draw the connection between the misdemeanor and the sentence. There's a couple of steps missing between what he did and the judge's conclusion.

Come on, no one is forcing him to do anything. The outrage here sometimes.....

He plead guilty to assault (a crime) after beating up his girlfriend's ex. The judge gave him the option of dealing with the consequences of his actions by the book (jail time) or marrying the girl.

The lesson learned: wives and family are worthy of violence to protect, girlfriends he's unwilling to commit to are not.

How can you guys possibly be mad at this?

Back in the day, a woman who was a serious contender for a man's interest could demand that the marriage contract be signed before he ever saw her vagina.

Whenever people talk about fights on the Internet, they almost never understand what really happens. I'm not speaking for you (so, please don't take offense!) but most of them haven't been in one.


The Internet's misconception about street fights are that they are almost never a "fight" in both parties throwing their dukes up, coming to some tacit agreement to get in a fight, and go at it. This almost NEVER happens.

What happens more often is one party sidelines and/or sucker punches the other party and continues the assault so they win the "fight." This is what I'm thinking happened here, because thats how it usually goes down.
