In a Harvard Business School report on the impact of CEO divorces on shareholders, the authors point out that a divorce could impact a company in three ways:

1. Loss of control or influence: "A CEO with a significant ownership stake in a company might be forced to sell or transfer a portion of this stake to satisfy the terms of a divorce settlement."

2. "Divorce can affect the productivity, concentration, and energy levels of the CEO."

3. "Divorce can influence a CEO's attitude toward risk, depending on how the divorce settlement is financed."

Even with a pre-nup, IIRC, money earned after the wedding is deemed marital assets and subject to an equitable distribution.

Let's keep something in mind here. Even if he gets "divorce raped" it's a pretty smooth, velvety rape experience with lots of lube. He'll still be a billionaire. He'll still live like a king. There are no kids involved. These aren't regular people.

Nope. If he acquired these stocks before or in between his marriages then the wife will not get any of them in CA since they are his separate property. It all depends on when he acquired the shares.

So, the $2.1 billion or a good part of it could all be his.

She's entitled to half of whatever salary he made during the marriage, so she's in for at least a $400 million payday.

Kim K's net worth is comparable to Kanye's, so there's not as much need for a prenup when the husband and wife are earning a roughly equal amount of money. Divorce splits assets acquired and earned during the marriage 50/50 but they're already 50/50 when it comes to their finances.

It would not be legal for hte board to require a prenup before any marriage.

There are a few like cases on point, usually where someone stipulates in a will whether or not they get anything if they marry someone or only giving someone a share in a will if they divorce someone.

With the prenup, most courts would probably rule it as illegal since it would be considered 'against public policy'. i.e. What right does the company have to tell someone how they are to conduct their marriage?

It is also the same reasoning a court will not enforce conditions in a will requiring an heir to divorce someone before they can share in the estate, it is against public policy to allow someone to use a will to break up a marriage.

Now there is a simular situation where the court will enforce a provision in a will, that is the condition where if a person marries a spouse the deceased person wouldn't want, then they can specify the hier be disinherited. The thinking there is if the person was still alive they could choose not to give anything to the couple, so with the will a court would allow them to do the same.
