They key point in rape cases is a subjective belief on the accuser’s part that the girl gave consent.

Obv if she’s blacked out drunk and motionless the jury won’t side with the accused but if she is simply tipsy then they will.

I don’t know how you can convict people of rape without consideration of their mens rea or mental state. It’s the same for murder. If they didn’t have the intent to kill it’s manslaughter

Yeah - I expect this to be rolled out everywhere.

Just record everything.

And even if it flounders - this is Iceland.

I will be enjoying my minimum security prison for 2 years, get to work out more and meditate, line up dozens of groupies. Then I am going to fuck through as many girls as the island can hold while already having the correct prison rep.

And besides - as I said before - just record it and upload it on Youporn the moment you are accused. When you roll up to the cops, just show the cops the link to the footage that someone must have uploaded illegally!!!

And strangely that someone keeps on uploading it from Thailand as you keep on paying that bloke via Bitcoins. I would love to see the court case where everyone has seen the video of her enthusiastically saying YES while she says that she was "brutally raped" against her will in court.

If I assume the person speaking Icelandic correctly translated the text it doesn't settle the question. It says "communicated with free will" this is the critical language. In the Icelandic legal system does "communicated" mean nonverbal ques? or is it more limited to verbal communication? The person to explain this would have to be an Icelandic speaker who also knew the law system there and could discuss what the effect of the words would be.

The closest comparison I can think of would be trials before so-called "rape shield laws" and trials without. Rape-shield laws have been used by prosecutors to attempt to deny highly exculpatory evidence.
