One of his lawyers, Adam Kenner, said the allegations are a ploy for compensation.

Thomas and his current girlfriend have a child together, the lawyer said.

Thomas will be tested for herpes as part of the case.

He has not directly commented on the lawsuit.

The article says that he is taking a STD test. If he does not have Herpes, does her case still have any merit to it at all? Or will her legal team try to come up with a way to prove he passed it along without infecting himself?

If he does have it, how can they prove he even gave it to her? Can DNA testing show correlation in the strains?

So basically she has to prove malice or negligence? Or does the player have the burden to prove that he did not knowingly pass it? Is her claims hearsay or did she have these statements on record like phone messages or paper, in order for the allegations to be part of the suit?

They were dating in 2010 but she waited 4 year before suing him for "sexual battery, intentional infliction of emotional distress, fraud through intentional concealment and negligence." She was well aware of the consequences of unprotected sex especially after noticing those puss-filled bumps but she still fucked him anyways. She has to prove that he knew, or should have known from a reasonable standpoint, that he had it and was putting her at risk of passing it on.

The reason I call bullshit is due to the nature of herpes which I wrote about here some time ago. If she didn't have it, she wouldn't possess antibodies for it. If he had infected her, she would have been like the other 99% of the population who get it, and she would have developed symptoms 2-4 weeks after infection. (The remaining 1% who get it may never have an outbreak their entire lives.) It wouldn't have taken over a year for her to develop symptoms.
