Tesla and SpaceX CEO Elon Musk is getting divorced from his actress wife Talulah Riley for the second time-and it could make a serious dent in his fortune.

The tech tycoon is worth $13.2 billion, according to Forbes, and the divorce filing that Riley made in Los Angeles Superior Court on Monday does not mention a prenuptial agreement. She wants spousal support and attorney fees.

In the divorce papers, posted online here, Riley cites irreconcilable differences as legal ground for the divorce and asks that she be allowed to file a report of the couple's assets at a later datesince "the true nature and extent of community property assets and obligations are unknown at this time."

A focus on the minutiae of figures related to "issues of spousal support, property valuation, property division, tax consequences, and attorney's fees and costs" suggests that this could be a bitter battle, and Musk has 30 days to respond to the petition.

This is the second attempt at marriage for the couple, who first wed in 2010 and divorced in 2012. Riley reportedly received $4.2 million-and was allowed to keep her Tesla Roadster and her Cartier and Gucci watches-in that settlement (Musk was worth $680 million at the time). She also received a tender tweet from Musk: "It was an amazing four years. I will love you forever. You will make someone very happy one day." That someone was Musk again. They remarried in July 2013. Musk made $2.9 billion that year, thanks in large part to an $2.1 billion increase in the value of his Tesla shares.

Unless there is a second prenuptial agreement (to go with their second marriage), Riley could be entitled to a figure in the billions, says Cohen, who is not involved in this case. The prenup that applied in the first divorce does not automatically carry over into a second marriage, so the couple would need to have agreed to a new one that is still valid. Cohen says he can't imagine that someone with his wealth would not have taken that step.

In a Harvard Business School report on the impact of CEO divorces on shareholders, the authors point out that a divorce could impact a company in three ways:

1. Loss of control or influence: "A CEO with a significant ownership stake in a company might be forced to sell or transfer a portion of this stake to satisfy the terms of a divorce settlement."

2. "Divorce can affect the productivity, concentration, and energy levels of the CEO."

3. "Divorce can influence a CEO's attitude toward risk, depending on how the divorce settlement is financed."
