You say whatever you want under oath (Eidesstatliche Versicherung), just end it by 'I am afraid' and, whaa, you can make a crime of such simple things like meeting someone on a street. You can then give his name to everyone, put his name on home-made posters, call police, even attack as a first one, just because you are afraid. And security, especially German security, has always been very highly priced in Germany. In my opinion, it is not just SJWism, which does not really exist in Germany (at least in the sense of spontaneous activity and subculture) besides government mandated virtue signalling, but the expression of rather low German cultural traits.

Somewhere very deeply there is a dangerous vibe in German culture, a vibe which murmurs with 'denounce' and resonates with 'kill', denounce & kill, denounce & kill.

It is a pity that Germans do not really appreciate freedom and broterhood but just always try to get upper hand against each other. This is a culture of hierarchy, something like Japan. Ever dreamed about this friseur shop on the corner?! Now it could be yours, just a small trip to Gestapo away. Disgusting. It is one thing when a regime organizes persecution, it is another when it is driven by your neighbours.... And, mostly they never gave back what they took in Arisierung.

Compassion is rooted in empathy, and Germany is not a compassionate land. Fair play is not really important - Hochstapler aka con-man is an important cultural concept here to which Thomas Mann devoted his last novel (Confessions of con-man Felix Krull), safely writing from Switzerland.

And it is very true that the accused would get nothing in compensation here. In Germany, to get even small compensation you must prove that someone either did something deliberately (vorsatzlich) or did not fullfil his legal duty (Pflicht). That essentially means that there is incentive in the system for false accusations, since you can never prove that someone said a lie deliberately AND in order to inflict a loss or harm upon you. Germany is always full of do-gooders who do harm.


And the obsession with duty transcends everything, ethics, law - as a good exemplification, just recently there was an article either in SZ or FAZ newspaper, discussing whether Von Stauffneberg did broke his oath, trying to take Hitler life in 1994. However German 'duties' are usually narrowly defined, there is no general doctrine of 'duty of care' here. If something is not clearly in law, it is not a duty, haha! There is perverse, hidden racism in refusing to assimilate such foreign concepts here, a sign that Germans still somehow consider 'the German way the best and only way', still being silently in contests with French and British cultures, as always they used to be. I once had a discussion with my old German landlord, who liked rambling about duty and Kant. I had to explain to him that Kant's notion of duty is rooted in the transcendental subject, not a current law on the books. I mean he took from Kant what he understood, and he understood what his culture learnt him.

Essentially all that means that there is no real recognition of personality and human rights (Personlichkeitenrechten) in Germany, nor mental anguish and humiliation, for example. Human righst are foreign concept from France here.
Human righst are not duties and thus do not really exist in German mentality. From this perspective, you could say the subjects of human righst do not really exist.
Neither Mollath nor Kachelmann, two recent victims of big justice scandals, got anything.
Moreover, no one is really concerned with them. No reparations for injustice in Germany. Cry for yourself in your pillow, loser. That is a message here.
The great cultural narration of seeking to amend injustice does not exist in Germany. Michael Kolhaas, a character of Kleist story who went such a way, is presented in a school narration as someone who exaggerated.
By the way, it is interesting story to read, much more than a recent film with Max Mikkelsen (pretty good on its own, too), since in the story actually almost every figure - even Martin Luther - admits that Kolhaas is right, but still nothing can be changed in his case. It is a deep story about cultural fatalism of Germany.
