Teacher preggers after statutory rape of student

I´m not familiar with US Law. Can someone tell me hoy many years she might spend behind bars. Also I´m a bit confused about this statutory rape concept. That´s only applied when there is a minor involved? Also why is it called rape, if there is no actual force or threat involved. It doesn´t make much sense. I would understand if the minor was a prepubescent child, but a 17 old (be it male or female)? And I assume in that state the age of consent is 18 years or else it would this would be legal.

In the US, there is a common misconception that 18 is the magic number for age of consent. This is false - 18 is the age set federally at which someone can participate in pornography. Having consensual sex is set at the state level - some go as low as 16, I don't recall offhand which, but there are 50 different ones with varying laws. Some states have clauses about age differences. For example in some states it may be ok for a 16 year old to have sex with an 18 year old, but not a 28 year old. It is called statutory rape because by statute, even though the minor may consent, they are not legally allowed to do so. They use the word rape probably because there is no other word to describe unauthorized, illegal sex. Since a minor can't even sign a legally binding contract until age 18, the attitude is they don't know what to do with a dick yet either.

Yes, I know, back in Viking times if a daughter were not married by age 16, she was considered past her sell date. This brings up an interesting side note - in some states age of consent is different for unmarried versus married people. A year or two ago, a 40 year old high school track coach married a 16 year old student of his. He did not have sex with her until after they were married, the cops monitored text messages and in the end there was nothing anyone could do about it - they got married and are probably having massive monkey sex right now with no laws are being broken. However, if she is under 18 and they decide to get a bit racy and take a home video of the coitus, guess what? They just violated a federal law against child pornography and the husband (the adult) can be arrested while the wife (the minor) of course would not be. Child pornography is a felony and sentences can easily exceed ten years.

Additionally, there are some US states which set laws against persons in positions of authority such as teachers, cops, clergy, etc. being involved with a young person who otherwise may be legally allowed to have sex with someone the same age as their teacher, etc.

I don't know the laws of the state in question (Wisconsin?) but even if it were legal the school districts most definitely have mandatory termination for teachers caught in flagrante delecto with a student.

Another thing to keep in mind is even if you travel to a country where the age of consent is say, 16, you as an American can be charged with a crime if you traveled to the country "with the intent" of having sex with a minor. Presumably if you were there for other reasons and "it just happened" that you got frisky with a someone not yet 18, you would not be charged - but I would not risk anything like that.

You can see that age of consent is a tricky question no matter where you are, but America has a strange understanding of it all. Europeans are often scratching their heads at the American attitude of 18 being the magic number, even when it legally may not be. We're also talking about the same country that tried to permanently outlaw alcohol, so this shouldn't be surprising.

A lot of guys reading this forum coming out of high school where they can remember 14 year olds regularly banging seniors may find all of this a bit bewildering, but it is extremely important to keep these things in mind when it comes to age of consent.

Forget progressive attitudes everywhere else, when it comes to this area, you are still in 1950's America. Therefore, if anyone ever asks you "did you bang so-and-so?" and you have doubts as to whether or not you are legally in the clear, SHUT THE FUCK UP and never say anything along the lines of "I did but I didn't know she was X years old." as this will not only not help you, but probably get you arrested as it makes no difference what you did or did not know. My advice is to stick with 18 year olds and up regardless of your age - it just isn't worth the risk of doing anything else.
