Never in FL it will sit for years unless you get pulled or there is a warrant sweep in that county then they give door knocks.

Was going to recommend iMech drive out to check on him, but being Sunday @9:10 p.m. on East Coast time, he's probably already 425ml into a 750ml bottle of vodka. Probably not a good idea to have two members of the forum running from the law.

Where I am, it's pretty much the same. When I first got admitted, a guy came into my office, possibly accidently, who had an outstanding warrant which was issued over twenty years before. Usually, if people who have outstanding warrants don't get stopped in traffic, they rarely get executed. I don't think the police department and the sheriff's office necessarily have the resources to start knocking on the door of everyone who has an outstanding warrant.

Merenguero, why is the Public Defender's office better than Legal Aid? You're the expert so I'm sure you're right, but I'd be interested to know more if you feel like it.

Where I am, at least, criminal defendants are not legal aid's problem. They represent people in some kinds of civil cases. I have had cases where they have represented the opposing party in domestic and breach of contract cases. The Public Defender's office represents criminal defendants who qualify for their services.

Yep, I see. I know a lawyer who works for a Legal Aid Society and handles criminal defense cases (and always wins them it seems), so I assumed they always had a Criminal Defense division but it looks like in other parts of the country they only do civil cases as you say.

Exactly and the Public Defender's office always seems to be swamped, and rightfully so, because they handle thousands of cases. The Legal Aid Bureau, with a fully civil caseload, always seems to not have any cases other than the ones which they have to me and are always bothering the hell out of me about, i.e. constantly filing ridiculous Motions.

I always tell guys to take care of this shit immediately. It's Murphy's Law- It will catch up with you at the worst fucking possible time of your life.

Years later people lose jobs over it. I had to escort a dude that had fled the Marine Corps. 10 years later his life is on track, and gets pulled on a vehicle stop. His wife and kids were in the car and it was traumatic. Because of running for so long, they threw the book at him and he said his family wouldn't be there waiting when he returned 6 months later.

I think most of the time the court just wants to see more money on the table. Putting people in jail for trivial shit costs the country too much in the long run.

True, and when there is a fine imposed and the Defendant is given time to pay it, may judges will be reluctant to lock the guy up, knowing that he needs to be on the street to make money to pay the fine, so the government makes money. I don't know if I have had a client see the inside of a jail in years. I have a rough couple of months coming up, so maybe that will change.

Emech called and said he can't post right now, as he's at 9,999, and wants his next post to start a party thread. Dude was so excited I could barely understand what he said, but it went something like this:

Ali: Hello?
Emech: OMG! I'm at 10k posts! Do you see it?
Ali: On what forum.
Emech: Not Jezebel this time. They banned that account.
Ali: Oh, which one then?
Emech: RVF you idiot!
Ali: Oh, I got you on my ignore list.
Emech: Fuck you, just tell them and I'm going out for another bottle of vodka. Be back in a few minutes to start my party thread.

*click.

Anyways, don't shoot the messenger.

Don't turn yourself in if you can avoid it by getting the Warrant quashed. It is one of the biggest mistakes I see people make. Go to the Public Defender's first thing Monday morning and see if they can quash the Warrant.

This +1 million. I know someone that had some minor charges...ignored them for 7 years and then one day, surprise! Cops are at the door taking her away in handcuffs during a warrant sweep. She is good looking though and a bartender at the time so some chump posted bail for her and she roped in a lawyer to clean it all up for her for free.

She of course, after the lawyers work she didn't pay the restitution ordered by the court after lawyer man cleaned it up for her and then...kapow. Surprise. Disqualified for a mortgage and owes a the equivalent of 10% per month in interest over 5 years. Its like a lindsay lohan level of pussy pass.

The same goes for your taxes. Don't ignore IRS or state revenue letters. Eventually they will garnish your shit and put a lien on everything you owe. Then you have to pay tax, interest, penalties and fees to a tax guy to dig you out.

Why don't you call the number (the agency) on the letter and tell them the situation and see what you can do to remedy it. There's a good chance they'll tell you to go the clerk of court, get a paper signed and take that fucking class asap.

If they tell you they're just gonna throw you in jail hire a lawyer.

They're not gonna trace the call to find out where you live - hell they already know where you live because they sent you the letter.

Whatever you do, DO NOT WAIT to do this. Shit like this compounds.

I agree with this.

One thing that I found is that when you're up before "the state" (and by that I mean any governing entity), they will give you a break when you commit crimes against individuals, but they'll go harder when they feel you've disrespected the state itself.

Judges often take this shit personally, feeling as if you've disobeyed them and usurped their authority. That's why you often hear someone got locked up when they violated probation...yet the got the probation to begin with for fighting or stealing. Doesn't make sense, but that's the state for you.

Either call ASAP and come up with an excuse and hope for an extension or do like others suggested and get a public defender.

But don't put it off and be sure to do this on the phone not in person where they can cuff you.

Okay, I went through your messages and I think I have an idea of what might be going on. First off are you in any other legal situations? I ask because not taking the DUI class and associated counseling is a DMV issue and only results in non-instatement/revocation of your license. I've seen this happen alot actually..I'm in Fl as well. As for community service, typically probation will tell you if you can get an extension and if not requested they will disallow those hours acompleted after your targeted completion date. Probation would also be the ones to tell you if you are close to violating before issuing a warrant and/or arrest you at your prob meeting. I have heard of this occuring over community service hours. I have not heard of them mailing that you have a warrant, typically a cop serves notice/arrest. If the warrant is legit I'm thinking it could be over a prob violation for not completing your community service hours on time or for failing to pay a fine...they are tough as hell about those fines. Like other commenters I'd talk to legal aid or public defender (esp yours if you were assigned one for the original dui reduced to reckless). You need the warrant quashed, barring that contact your prob officer and explain the situation and ask to arrange a time to turn yourself in. That is a last resort though prob officers mostly suck but you definitely do not want to just ignore it or turn yourself in without making arrangements to do so. Good luck to you.

Whatever you do, don't respond directly to any contact information given to you in the letter. This may be legitimate, but we've seen a rash of copycat scams proceeding exactly like you described over on this coast: victim gets a letter about court appearance/warrant/etc, gets charged for "help" or to "make it go away."

Go to the PD's office first thing Monday morning.

You go to your local police station and pay the bail. You'll get a court date in the mail. Once you appear you'll get a check from the court providing they don't keep the money to put towards your fines.

There are scam letters like this. I would verify the number. I do not think the government sends you letters that you have a warrant. If they have your address, they send cops.
