Feminist creates empowered Facebook group then scrapes content for book deal

In October, a woman started a pro-Hillary Facebook group called Pantsuit Nation. Millions of women joined and shared their "inspiring" tales "against sexism." She took those stories, trademarked the group name, and got a book deal where it appears to the be the sole financial beneficiary. Her fellow feminist comrades feel ripped off.

The Times describes the project as “the collective voices of the women who shared their stories of overcoming or facing sexism, racism or xenophobia.” The book will be comprised of posts and images submitted to the Facebook page, and Chamberlain will act more as an editor rather than author, choosing what user content appears in the book.

However, this deal has already received intense blowback from Pantsuit Nation members. Harry Lewis, a student and male member of the group, published a blog at the Huffington Post titled “Pantsuit Nation Is A Sham.” The post appears to have generated 20,000 social shares at the time of this writing.

Lewis argues that Chamberlain’s book deal is a cash grab with “no transparency” regarding how, or even if, users will be compensated for the content they created

interesting. Given that all of this was posted on facebook, and facebook claims an irrevocable liscence to everything posted there, shouldn't they also sue her for a share of the book royalties?

We've already had that happen with stories from Fisto's SEA threads where someone plagiarized them and tried to sell them on Amazon. As far as I recall the guilty party was identified and banned from the forum after being called out.

This is so typical. If I understand this right, it's at the very least unethical.

Looks like she basically solicited free content from people under false pretenses, then re-packaged it as her own work without disclosure where she was the sole beneficiary.

Those people have every right to feel aggrieved. I'm not a copyright or trademark expert, but in the past I've asked attorney Mark Randazza a question. He's a great guy as well as courtroom Prince of Darkness (a good thing).

Copyright is automatic as soon as you create something, in the US anyway. Registration isn't required until you want to sue someone for infringement.

I'm not an IP attorney but unless the woman who started the group had a plan to do this from the beginning and designed her group membership rules to allow for it, she's not legally allowed to just take their work and compile it into a book. As described, what she's doing doesn't fall under fair use.

...But if there's a real book deal in the works, she probably did set things up so she had automatic license to use the content created by group members. If people agreed to that as a condition of joining, well, the warning was there even if they didn't take heed.

It's amusing from where I'm sitting either way. Either 4 million [Image: catlady.gif] got scammed, or there's going to be legal drama when the chick gets sued. It's always funny watching these feminist types run headlong into the brick wall of reality.
