Your texts from her should be all you need, don't delete them or do anything stupid. Consult your attorney ASAP. Do not contact her again or talk to anyone else. Assuming nothing else happened - aka your story is true and the way things went down - you shouldn't have much to worry about.

Don't talk to the police without your lawyer. Don't tell them anything without your lawyer letting you say it first.

There's threads on false rape accusations. Check them out. I think you should be fine as long as you don't admit to anything.

Had a chick try to extort me a few years back. Sh* like this just happens. Save your emails/texts, retain an attorney, and play hardball.

A law school professor and former criminal defense attorney tells you why you should never agree to be interviewed by the police. Then a former police officer was supposed to give the other side of the argument and ended up agreeing - never talk to the police, it cannot help you.

Thank God you have the "I'm home. Thanks for tonight." text.

Agree with above advice. Only talk to cops with your lawyer present.

Based on what you've said above, plus that text, I seriously doubt a DA is going to view this as worth prosecuting.

So, 1) relax but 2) lawyer up.

Lawyer up often means big money. Someone who is financially struggling could be financially hit pretty hard. I am curious to know what are the lawyer fees -- if anyone of us poor folks find ourselves in your situation.

Spoke with two attorneys so far. I haven't been charged with any crimes. Pre-charge fees were $1000 and up

Yeah, that sucks but the $$ is worth it. This is not going to happen to you regularly and staying out of jail/keeping your record clean is worth the $$.

One of two things is happening here. The first is that the police believe this girl's claims are garbage and just want to get your side of the story to confirm that bringing charges is a waste of time. The second is that they are pretty sure they want to bring charges against you and they want to get you to do or say something stupid in order to make probable cause all the more strong. I have no idea which one it is, but you should hire a lawyer, have the lawyer talk to the police, and specifically make the police aware of this text message you sent.

I've never taken a girl's bra off in my life or unzipped her pants or anything like that ever. I don't even know if I know how to take a bra off. If everything goes right, there's no need to and I have little patience with those other ones. There's a lesson in there.

Repeated for emphasis. Remember police and DA don't care if you're guilty or innocent. They only care if they can get a conviction or not

Do not talk to the police without a lawyer They will try and trick you into admitting your guilt. The minute you say something like "yeah she put up some last minute resistance but was still into it"... you're cooked

Do not talk to the police without a lawyer

The only advice you should take is from your lawyer, and not say a damn word further about this here or anywhere except to your lawyer. Never make a post about a real, current legal situation wherein you explain details, or even generalities. Things you, a layman, think are innocuous pieces of information are most definitely not. The importance of shutting your mouth cannot be stressed enough.

It's an automatic 60% warning if you request that the moderators here remove a post, but in this case it would definitely be worth it.

You shouldn't be describing the event here on a publicly viewable website, especially with terms like "LMR."

This isn't to say that anyone here thinks that you are guilty, but you wanted to limit your risk as much as possible.

Also, get a lawyer. No matter how much it costs, it's cheaper than the potential cost of sitting in jail awaiting trial and the cost to your reputation of charges are filed. Do not talk to the police unless you have a lawyer present. He should be the one doing most of the talking.

After it's all done, if possible post her name and picture of her online, with the text record and any information of the police report. There must be retaliation against people like this or more will do the same.

Telling people you were falsely accused of rape , is a bad idea, the court of public opinion will usually find the guy guilty regardless of facts, see the mattress chick saga for an example

This wouldn't be "telling", it would be "revealing with full evidence". Sane people are only able to side with mattress girl by deliberately avoiding the evidence. Shove it in the face of her friends, her family, her employers, printing out flyers and putting them in mailboxes and under office doors if necessary.

For every one that calls him guilty, he should go after them with the facts, raising as big a mirror before their morality as he can, forcing them into the cognitive dissonance of believing themselves to be good, but being unable to reconcile their actions with the reflection of their beliefs you force upon them.
