My advice in these types of situations is to cut off contact as soon as you think something is up. As soon as the "girl" says "I'm really bothered by this...." it's time for radio silence. Instead he tries to talk his way out of it. Admitting that she was fall down drunk and hit her head could be the nail in his coffin.

McDonald has not been arrested.
The 49ers released him Dec. 17, hours after police named him as a suspect in the sexual assault investigation, citing a "pattern of poor decision-making."
McDonald, who was the subject of a domestic violence investigation but was not charged after his Aug. 31 arrest, last played Dec. 14 at Seattle. The assault allegedly occurred after he and the team returned to San Jose.
The accuser told police she was drinking with friends before going to a bar in San Jose, where she said she consumed two more vodka drinks before feeling dizzy and asking to go home. The woman and her friends left with McDonald and his friends and returned to his home, where she remembered drinking at the bar in the upper level of his house and later falling by the pool.
She said she had no other memories of that night, though she spent most of the next day with McDonald, including drinking with McDonald and fellow 49ers player Aldon Smith. Smith is on probation after pleading guilty to drunken driving and weapons charges earlier this year.
The woman visited a San Jose-area hospital Dec. 16 and police were alerted to a possible assault. The woman gave a detective permission to communicate with McDonald via text message from her phone. In that conversation, McDonald told the woman she came on to him and that she should take the morning after pill.
The detective, posing as the woman, told McDonald he should not have had sex with her while she was unconscious.
"I don't understand why you're bothered. U chose to stay with me another day," McDonald said in a text message, according to the affidavit.
The investigator posing as the woman replied that McDonald shouldn't have had sex with her while she was unconscious.
"I didn't do anything wrong," McDonald replied.

Yeah its obvious when the cop takes over. I would of just ended that convo early and not respond. It draws on way longer and the use of shitty language would of been a red flag. Not to mention the fact they likely smashed more then once.
Dudes of high net worth sticking it into random women raw like that. Nobody is surprised.
I am having the morning after pill in a candy machine like gum if girls want to try and dupe me into hitting it raw if I am a athlete. I will never understand it though. You work hard as hell to get into a position to make that money in professional sports. Top 1% of athlete potential realized with hard work and discipline. Yet time and time again they choose to slip. I know pussy can be powerful but I would hope that you reach a different level of perspective and clarity at that level but I guess not.
What is interesting if they use his home security cameras as evidence. Is it illegal to secure you home with cameras in-case of a burglary ? Does the bedroom differ in private space then the home itself?

You gotta be carefully. You can edit your stream of text message balloons on iPhones and make it look like something it's not.
If you press and hold on the balloon it'll give you the option to delete the message or multiple messages.
I'm sure if you creatively delete certain messages you can make it look like something it's not. Courts and cops aren't smart enough to know all these tricks.
