A man suspected of raping a woman at knife point after hours on the El Molino High School campus was to be released from jail Thursday after prosecutors said they found evidence that may clear him of the assault.

Sheriff’s officials initially said a masked David J. Kocalis, 24, of Guerneville sneaked up behind the woman Aug. 30, held a knife to her and raped her near the Forestville school’s tennis courts.

He was arrested the next day on charges carrying a possible life sentence after the woman identified a prominent tattoo, and the car he was driving was captured on videotape.

But prosecutor Brian Staebell said Thursday investigators have since uncovered evidence that may point to his innocence. A judge allowed Kocalis, who had been held on $1.2 million bail, to be released on his own recognizance.

His lawyer, Evan Zelig, said a review of cellphone records showed Kocalis and the 18-year-old woman knew each other. Earlier in the day, she sent him a text message inviting Kocalis for sex, Zelig said.

Their tryst began inside his borrowed Porsche SUV but moved to a spot near the tennis courts because the car’s alarm kept going off, Zelig said.

After it was over, Kocalis drove the woman home, the lawyer said. She fabricated a story about being raped because she missed her curfew and Kocalis refused to lend her $20, Zelig said.

“It was determined her story was not credible whatsoever,” Zelig said outside court. “It was completely made up.”

Zelig said he brought the new information to sheriff’s investigators who analyzed both cellphones. They confirmed the messages as well as attempts by the woman to delete her own texts, Zelig said.

Staebell declined to discuss details other than to say a review was ongoing. Judge Robert LaForge ordered Kocalis to return to court Oct. 6 for further proceedings.

Prosecutors could announce then that they are dropping the charges.

“We have an obligation to find the truth,” Staebell said. “We’re going through the forensic evidence with a fine-toothed comb and doing everything we can to determine what occurred during this incident.”

It is because the word rape has been so overused and real rape crime cheapened ("that guy looked at me, im pretty sure he wanted to rape me"), that a woman now views making a false rape accusation a legitimate course of action.

I think it will be increasingly common for false accusers to get outed in the media. And why does the innocent guy get named and shamed, but the woman who wasted police time not?

This should not be. The names of the dudes getting falsely accused are out there in the public domain. That's an outrage in itself but we can turn the tables using this fact. It should be possible to track these guys down and ask 'em for the names of the false accusers. If they're still white knighting after all that and refuse to provide the name then what can I say, fuck em.

Then, set up website shaming directory linking stories like this one to names, photos, and social networking profiles and publicize the shit out of that site. Make those people's names forever associated with their evil deeds so when they try to find jobs, run for office, get married and otherwise advance their lives they pay the price. Shouldn't be too hard. I imagine once such a site gains a critical mass of followers, we can then run a false flag and "complain" to feminist and leftist media about it's existence and they will do the bulk of the publicity campaigning for us...

Thats how I caught my false rape charge. The girl was out past her curfew. She even gave my other friend a ride home from my house and he said the closer she was getting to home the more she was scared saying her dad was gonna kill her and stop paying for her college. Next day 7 cop cars roll up to my house, this is the day I was supposed to leave for Germany when I as in the AirForce. The fake rape took place at my going away party. My mom asked what happened when the cops where in the drive way and I said I have no idea, she said what do you want me to tell them and I said tell them I'm not here. They come in and she says I am not there they are walking down the hall way towards the room I am in then they asked where my one of my other friends was and she said down stairs. I peeked out the door and saw the last cop walk to the basement and I waited 5 seconds an bolted out the front door. An my friend who was giving me a ride to the airport just happened to be pulling down the driveway. I jump in his car and start yelling for him to get out of there. I call home a hour later and find out there's a warrant out for my arrest for rape. I go eat Chinese lunch buffet and then turn myself in. The girl dropped the charges the day of court, so it never went to court. But its followed me my whole life. It shows up on background checks for jobs, it shows up when I get a speeding ticket. I was trying to fight a ticket for illegal exhaust 9 years after the false rape charge and before court my lawyer comes to me and says "Whats this about you raping a girl?" An that the Commonwealth attorney was out to get me.... I still beat the exhaust ticket. I paid a lawyer $600 to have the false charges that never even went to court expunged off my record. It still shows up on background checks.

Fucking BULLSHIT.

Its a sad day we live in.

I dont know if there is even a statute of limitations to make a fake rape claim. Nevertheless, for now on I will stop deleting text conversations from females I banged. Even if months have passed preserving those messages could mean the difference between a few days or a few years in jail.

The problem is that the girl would most likely be the one who he would have to sue for malicious prosecution, abuse of process, and/or false arrest. The prosecutors and police were arguably just doing their jobs and happened to have an alleged victim who is/was a lier. Something like 95% of the world is either broke or worse than broke, so I'm guessing that a girl who is trying to borrow $20.00 falls into that 95%. Obtaining a monetary judgment against an indigent person generally doesn't accomplish much and it can be very time consuming.

Has reading articles and first hand accounts like these actually changed how you deal with girls?

I have dealt with several girls who honestly seem crazy to me. I have completely stopped dealing with girls like these. In the past, I used to think it was a kind of cheap thrill, but now I just want a nice sweet girl.

However, it's weird because when a girl isn't into you, she'll just stop responding to you and expect you to let it drop just like that. So you think that's how girls work. Then if you ever try to do that with a girl who's into you you'll be getting texts for God knows how long after...

I am honestly nervous sometimes, I get texts from numbers I have long since deleted... A couple times they have been straight harassing, just insulting me in really mean-spirited ways, sometimes they have been thirsty like, haven't seen this chick in forever and she's inviting me to this or that event. Sometimes, this is the saddest, they're legitimately just like "Hey what happened to you, why haven't I heard from you?"

Anyway, I have stopped being so cavalier about just getting it in with whoever I can... being a lot more picky these days. What percent of the population is under 30, thin, not crazy, and nice? Much less than 1% I would bet...

Courtney Love apparently talked shit about her former attorney on Twitter. Her former attorney pursued a libel case against her.

We'd be sitting in court for hours, listening to the judge ramble on and on about due process and shit, before we took a recess and were informed the details of the case. Once they told me what the case was about, I was livid. I had to request a day off just so I could sit in court and listen how some completely burnt out whore who probably killed Kurt Cobain talked shit about her attorney (a woman of course) and now her attorney wanted her share of the pie.

What I really saw in court were two spoiled little shits clamoring for money they have no right to. When the judge started asking members of the jury if there was any reason that anyone felt that they couldn't uphold justice that day, to please raise their hand, I shot my hand up. I said right there in front of the courtroom "I don't care what the libel laws are, I have my own sense of justice and this case is a waste of time." or something to that effect.

If a celebrity libels a private party over Twitter, making a claim that said party is "incompetent", our courts go to great lengths and spend taxpayers money so that private party can sue that defendant. Over a stupid fucking tweet.

If a woman reports a man to the police, making a false claim that said man is a RAPIST, there are seemingly ZERO repurcussions against that woman. At least until recently, and thankfully it seems the tide is turning.

Lawsuits can be costly. The filing fee is not bad. It should be between $100.00 and $200.00. If the Plaintiff can't afford the filing fee, it can sometimes be waived. The true costs are the deposition costs, private investigator costs, expert witness costs, and the fee for copies of records. In some cases, this can amount to hundreds of thousands of dollars. Litigation also takes up a great amount of an attorney's time and may cause him to have to forego other cases. If the person who is being sued declares bankruptcy, all litigation must stop in many cases, and an attorney may very well have wasted time and money in pursuing a Defendant who is declaring bankruptcy. Generally, when a Plaintiff sues a Defendant for monetary damages, the attorney is paid on a contingency basis, meaning that the attorney charges the Plaintiff one-third of the amount of any settlement which is obtained without filing a lawsuit and 40% of any settlement or verdict which is obtained after a lawsuit is filed. the contracts and texts are easily reduced to almost nothing whenever the girl
says to the authorities:
