NJ Court: Woman Can't Sue Nets CEO After Abortion

Quote:Quote:

NEWARK, N.J. (AP) -- A New Jersey appeals court ruled Friday that the former girlfriend of Brooklyn Nets CEO Brett Yormark cannot sue him for allegedly failing to keep promises he made on the condition that she have an abortion.

The court ruled that while Reyna Purcell's decision may have been influenced by Yormark, the final decision to end the pregnancy was hers.

''Under the law and public policy, there is no cause of action for terminating one's pregnancy and then regretting the decision due to subsequent events,'' the two-judge panel wrote.

Reyna Purcell, now 35, got pregnant shortly after she started dating Yormark, according to court filings. Purcell claimed she wanted to keep the baby, but Yormark threatened to break up with her if she did not end the pregnancy.

Purcell claimed Yormark promised to stay in the relationship and take her on vacation if she had an abortion, according to the ruling.

Purcell had an abortion in February 2011, according to the ruling, and Yormark ended the relationship soon after.

Purcell sued, saying Yormark fraudulently and maliciously coerced her into terminating the pregnancy and inflicted significant emotional distress.

A judge dismissed the case, ruling that because Yormark's promise was verbal and no lawyers were consulted, it was not enforceable. Promises of support outside of marriage must be in writing in order to be legally binding, the judge said.

interesting, was she suing for the value of the vacation in addition to distress? If so isn't that sort of like a hit man taking his client to court after not paying up after the job is finished? This bitch was JUST manipulative enough to get played. On one hand, she could threaten him with the baby, get child support, but she'd lose him. Or she could keep him, have a great lifestyle (suite at the Nets games, vacations, etc.) and probably try to get pregnant again by him later once she got herself locked in. She thought she held ALL the cards, but he was smarter. Without a legal contract, you'd never be held to verbal promises regarding a personal relationship. Just like men don't get to decide if a chick KEEPS a baby, they don't get compensated for terminating a pregnancy. Her clock is running out, and she forfeited a golden opportunity to be a mother for the promise of a vacation? This bitch is too stupid and selfish to be a mother. If that aborted fetus is in heaven, he or she should be thankful that this bitch didn't bring them into the world...HA HA!

I think she just wanted to stay in the relationship. She believed Yormark that he'd bail if she had the baby, and would stay if she didn't. I actually feel bad for her - she got an abortion and probably got lied to, and nothing to show for it. She wasn't aware that 1) she held the cards and 2) verbal agreements 'aren't worth the paper they're written on.' Besides, even if he did agree in writing to staying, how long would he be required to stay?

No doubt. She wanted HIM. But it should have dawned on her that when he asked her to have an abortion, it spoke volumes about what part she played in his life. And when she accepted the deal to have the abortion in exchange for a vacation, it was further confirmation to him that he needed to dump her. What kind of woman does that? Of course, he should have taken the necessary precautions to make sure she didn't get pregnant in the first place, but that's a different discussion (Tariq Nasheed did a nice piece on this, in how chicks only get pregnant because they WANT to be pregnant. If you let a man inside you raw, you're okay with having a baby). I'm sure he lied to her, but really needed a guarantee that she was going to terminate the pregnancy. He'd have probably respected her more if she'd said no, even if he was going to end the relationship anyway. She shouldn't have wanted anything to do with him after he actually offered a vacation as a consolation prize for ending her pregnancy (I mean...negotiate for something more valuable, like a diamond or something...HA HA!). At 35, she may not have many more opportunities. It's obvious that he doesn't want a family with you, so she should have ended it. Find a guy that DOES want that with you. But she had visions of the kind of lifestyle she'd enjoy with this guy, so even after he spit in her face, she tried to cling to him. Pitiful.

I respect the fuck outta dude. He took a situation in which he was going to lose, and turned it completely around and won.

Reminds me of a Leykis bit in which he instructs young men on what to do if you get a girl pregnant:

1.) Coax her into getting an abortion, saying "this is not the right time, we'll have kids further down the road"

2.) Go with her when she gets the abortion, when it's all over with take her home and put her to bed.

3.) Delete her from your contacts list and never speak to her again.

The vacation was probably just a cherry on top. "Baby, I promise I'll stay with you if you don't have the baby. I'll even take you on vacation, I promise."

I understand where people are coming from. Girls are always trying to hustle you, to the point that you celebrate it when a guy hustles a girl. It's not clear if she was a hustler or not. You lose your humanity when you see *every* woman as automatically a hustler, and thereby justify screwing them over in any way possible.

If she was indeed a hustler, then I'm mostly in agreement with the people here. I suspect she isn't, because then she wouldn't have given up so easily without a written contract.

Like the judges said though, an agreement to "stay together" is unenforceable and vague.

I don't think she was a hustler per se. I think she found herself a good catch, and agreed to whatever she had to in order to remain in the picture. But she was still trading the baby for something considerably less. If a child was what she wanted, and more importantly, if she wanted a child with HIM, it was clear the moment he asked her to terminate that she wasn't going to have that with him. She probably would have resented him, even while remaining in a relationship with him. You have to figure an ultimatum was on the horizon. She got pregnant because she wanted to, then caved in. It was clear she wasn't going to get EVERYTHING she wanted, and decided to choose him over the child. There's no substitute for a baby if that's truly what you want.

Important to note that this was on appeal, which means the original court took the girl's side. I'm not sure if they actually ruled in her favor or merely ruled she had standing to sue, but, still.

I genuinely feel bad for the girl, because she was so entranced by the cock that she killed her own child on his say so. It wasn't about the vacation it was about the fantasy of a continued life with him.

Also, I don't doubt for a second that the guy's status as a wealthy and famous sports owner/CEO influenced the decision. If it was some regular joe being sued by his ex, it might well have gone differently, especially with a feminist judge.
