Basketball prospect Tony Farmer gets 3 years for kidnapping girlfriend

A highly-recruited Ohio basketball star collapsed in court after a judge sentenced him to prison for assaulting and kidnapping his girlfriend.

Courtroom news cameras caught the shock on hot college prospect Tony Farmer's face as Cuyahoga County Court Judge Pamela Barker gave him three years for kidnapping in the April incident.

"I got three years?" the stunned 18-year-old asked his lawyer, Joe Dubyak, according to video posted on WJW Cleveland television.

Barker continued with sentencing, slapping the 6-7, 220-pound star with two years for felonious assault and two years for robbery.

Convinced he was headed to prison for seven years, Farmer collapsed in a heap at his lawyer's feet, as anguished supporters cried out and fled the courtroom.

"I haven't finished yet," Barker said from the bench, as a court officer struggled to hoist the handcuffed Farmer to his feet.

"Tony, come on Tony," Dubyak said. "It's not as bad as you think it is."

After Farmer stood up, Barker announced the terms would be served concurrently and that Farmer would spend three years in prison.

Farmer, a rising senior at Garfield Heights High School, was indicted in May stemming from a fight with his ex-girlfriend, Andrea Lane, at her apartment building in Bedford Heights, southeast of Cleveland, the Plain Dealer reported.

Farmer assaulted Lane, dragged her by her hair outside the building and then took her cell phone, bank card, computer and car keys, prosecutors said.

He was also charged with intimidation for sending threatening text messages and voicemails to her, the newspaper reported.

Farmer was an all-state pick in his junior year and considered one of the top 100 recruits in the country.

Several NCAA Division I powers, including Michigan State, Illinois and Xavier, were recruiting him, according to Yahoo! Sports Rivals.com.

The judge said she would review his sentence in 180 days, according to the Plain Dealer.

He dragged her by the hair and took her shit. Not okay, but how is that kidnapping and robbery? It's a relationship fight. Send him to an anger management course. Even though the kid looks like he can't spell his own name, he is still a kid. At 18 years you can do stupid, impulsive things. Not okay, but is it fair to ruin everything, throw away his best years and future? Is society helped by that?

He'll never be accepted to a good college or get a good job now. Three years on top of that?

He may not be serving anything close to three years. He plead guilty, so his chances of winning an appeal would be slim and none. I have never heard of a Defendant who plead guilty having his conviction overturned on appeal. It is theoretically possible, but it does not really happen. Those types of appeals are generally reserved for cases of illegal sentences, lack of jurisdiction or venue, and ineffective assistance of counsel. I am quite sure that this guy either signed a form stating that he was satisfied with the services of his attorney or that he gave an affirmative response to that effect on the record. I will be shocked if his convictions do not stand.

The judge may review his sentence in 180 days. His attorney may have to file a written Motion for Reconsideration of Sentence explaining the reasons why his sentence should be reduced. That is the procedure in the jurisdiction in which I practice. At a reconsideration hearing, he may have a chance at getting his sentence reduced to 18 months or even to a year. The factors the judge will take into consideration are his lack of prior record (if that is the case), being remorseful for his actions, his ability to earn a G.E.D. prior to the reconsideration hearing, and his ability to be employed upon his release. His attorney may want to get him screened for home detention while he is awaiting a reconsideration hearing. He will be given credit for time served during the time he is awaiting a reconsideration hearing. If his sentence is reduced to a total of a year, he will be released a few months after his reconsideration hearing.

If Ohio law permits it, he may want to file an Application for Sentence Review by a three-judge panel. In the jurisdiction in which I practice, a Defendant who is sentenced to a period of incarceration of two years or more is entitled to request such a review. I have had mixed results with such applications. Often, the sentence has to be outrageous in order to be reduced by a three-judge panel. This guy's sentence was excessive, but in my opinion was not outrageous.

A Petition for Post Conviction Relief based on ineffective assistence of counsel may also be a possibility. Ohio law permits that. The fact that he plead guilty could seriously affect his chances of prevailing on such a Petition.

Regardless of whether his sentence is reduced, a felony conviction on his record will screw him as far as ever playing basketball at a decent college. Although he was highly recruited, I do not believe his game as at a level which would allow him to play professionally anywhere, especially after spending an excessive amount of time in prison. Being locked up for a long time can be fatal to athletes.

I wouldn't agree with that. Sometimes they are made examples of and for sure get fucked, but the rich and famous ones get away with a lot of shit. Way more than your average person would. The flip side is that they get the spotlight put on them more, so it seems like a lot of them go to prison, but really it is a small minority of them.

And I for sure wouldn't feel sorry for Floyd. He's been charged with similar crimes nearly half a dozen times. If by some chance he isn't guilty of any of those crimes, then he puts himself into shitty situations way too often for me to feel sorry for him. And I even like Floyd as a boxer.

It looks like Mayweather has gotten off EXTREMELY easy for what he has been charged with over the years a well. Who knows if he actually did the shit he was accused of, but I highly doubt anyone who wasn't rich and famous gets off with such little punishment as he has.

I respectfully disagree. They get away with so much stuff they just keep escalating, and if they don't have good core values/basic smarts, a lot of them will just get themselves jammed up eventually.

The legal system is manipulated by humans and there is usually no clear cut answers with law. Heck lawyers are trained to argue every rule. No wonder legal bills are through the roof. Penalties IMHO should be the same for all who did the same crime. For example, You stole a shirt, you get this many months etc.

Politicians won't be changing the need for society to get ripped off by lawyers because most of them were practicing lawyers before becoming politicians. My buddy was suing an ex business partner. Nothing big maybe the Dispute was $50k. He had to pay $400 in photocopying fees. He says to the lawyer jokingly is that paper made from gold? they rip you off! Lawyers and $$$$$$ will set him free.

Anyhow back to the topic....this boy farmer deserves the same punishment had he been anything else. Mike Tyson went to prison in his prime, so this cat should do time too.

I agree. You can be a model citizen, great student, paying taxes on time your whole life then one night in a bar some stupid shit goes down that you didn't even instigate and voila, your life is utterly ruined in an instant by the criminal justice system and all that hard work goes down the toilet. Punching some dude in the face and the like should not be cause to destroy lives and demarcate "normal" people from some satanic notion of a "felon."
