Woman awarded 0,000 K in herpes lawsuit...

Okay guy's this could make for some interesting conversation, an Oregon woman just won a civil lawsuit for $900,000, that's right (6 zeros), in a case against a man she alleged gave her herpes.

First of all, I don't know how the fuck the guy can ever pay that shit off, unless he's a millionaire. Second, the guy is 69 year old, but if this happened to a guy in his 20 or 30's, would he be doomed to be in debt and have his wages garnished the rest of his life, to pay this shit off?

I'm not advocating people going around and not disclosing their STD's... But, I don't see how a person can sue for that much money over herpes. I mean, right off the bat 1 in 4 American women already has it, and a huge portion of people carry the virus and don't even know it because they haven't had an outbreak of symptoms.

Furthermore, herpes, isn't really that big a deal in the grand scheme of things, it's not life threatening, it's just a bout of unpleasant cold sores, that usually will only last a couple weeks if you take anti-viral meds. I could maybe fathom someone getting awarded $9,000 in a case, but $90,000?

Reading shit like this makes me think it might be time to start thinking about moving out of the U.S. All it takes is one wrong move, and the system can fuck you for life.

Whether you think herpes is a big deal or not, if you knowingly give someone an incurable disease, there will be repercussions for that. It doesn't have to be fatal. If the disease were fatal, it wouldn't be just a civil trial - there would be a criminal one. Herpes does alter your life in certain ways. It can be hard to quantify pain and emotional suffering. While he may not have known he was contagious right at that moment, he has a greater responsibility to protect potential partners from the disease if he isn't going to divulge it. He should have wrapped up. It's also possible that he won't pay much or any of the judgment against him. Since he's retired, he may be drawing a pension of some sort. Pensions can't be garnished (OJ Simpson was living on his NFL pension, and the state couldn't touch it). The state can take certain assets and auction/liquidate them, but as long as he doesn't take another job, they can't get anything out of him.

I just don't know how they can prove that she didn't bang someone else and get it. Why did he admit that he had it?

The best part: it happened in Beaverton, Oregon. You couldn't script this better.

The woman, who filed the case under a pseudonym, testified that she asked her date to wear a condom and he said OK, but the next thing she knew he wasn't wearing a condom and it was too late. Afterward, as they were lying in bed and talking about the chemistry between them, she said he broke the news to her: He had herpes.

Quote:Quote:

He testified that he told her that he had herpes not out of guilt, as she contended, but because he liked her and wanted her to know there might be times when he had an outbreak and he would have to refrain from sex.

Quote:Quote:

His attorney argued that the woman was careless -- that she should have demanded he wear a condom because without one "everyone knows you're at risk for an STD."

So, the guy admitted he had sex with her, without a condom, and that he knew he had herpes. Easy lawsuit.
