It's a combination of a lack of accountability in society (in particular, women being held accountable for themselves) and our runaway penal system. Prosecutors get paid/promoted based on their volume of convictions and prison years accumulated. So they burn everyone they can unless that person is deemed off limits by the powers that be (the mayor's kid for example).
Bad societal trend (female carte blanche) combined with bad criminal policy (prosecute everyone) equals clusterfuck of epic proportions.

Horrific if it actually sticks in court. I believe we should emphasize personal responsibility in our legal system. He did not make the choice to sit behind the wheel after having a few too many.....she made that choice.
